Rules
I. Description of the Quit to Win! Challenge
  1. The Quit to Win! Challenge is a health-promotion campaign aimed at people who want to quit smoking. The goal of the program is to improve their quality of life and life expectancy by changing their habits.
  2. For participants, the challenge is to not smoke, that is, to not inhale tobacco smoke or use products containing tobacco including, but not limited to cigarettes, cigars, cigarillos, or pipes, for a minimum period of six weeks, from February 6 to March 19, 2017, inclusively.
  3. Persons duly registered for the Quit to Win! Challenge who satisfy the conditions set out in the present rules and regulations will have a chance to win a prize for their participation if they are still non-smokers at the time the winners are declared, on March 22, 2017, and, if applicable, until they have passed a screening test.
  4. Registration is free of charge, and all persons registered for the Quit to Win! Challenge may change their registration at any time up to February 6, 2017, inclusively, at quitchallenge.ca.

 

II. Eligibility
  1. To be eligible for the Quit to Win! Challenge, and for the prize draws, candidates must:
    1. be duly registered for the Quit to Win! Challenge;
    2. reside in Quebec (i.e., their permanent residence must be in Quebec and they must live there on a regular basis);
    3. be a smoker as of December 20, 2016, that is:
      • have smoked at least 100 cigarettes in their life and still smoke cigarettes on a daily basis or occasionally (at least once a week);

      or

      • smoke a pipe, a cigar, a cigarillo or consume other products containing tobacco on a daily basis or occasionally (at least once a week);
    4. commit to the following: to not smoke from February 6 to March 19, 2017, inclusively;
    5. register on their own, with a non-smoking sponsor, or with a fellow smoker who also wants to take up the Challenge;
    6. not smoke up until the date that the winners are declared (March 22, 2017) and, if applicable, until they have passed a screening test.

Sponsors who are supporting a participant under the age of 18 must be over 18 years old. If the participant opts for the “smoker-smoker” formula, his or her teammate may be under the age of 18.

Exclusion: A person may not register for the Quit to Win! Challenge to stop using products that are illegal in Quebec (marijuana, hashish, etc.).

  1. Capsana employees, representatives, agents, or members of the eligibility committee, and persons living in the same household are not eligible for the Quit to Win! Challenge drawings.

 

III. How to participate
  1. Registration for the Quit to Win! Challenge contest takes place from 12:01 a.m. (EST) on December 20, 2016, to 11:59 p.m. (EST) on February 6, 2017, inclusively, (the "contest duration").
  2. All those interested in participating in the Quit to Win! Challenge must fill out and submit a single registration form for the Quit to Win! Challenge either by using the online form on the Quit to Win! Challenge website or by telephone through the iQuitnow helpline (1 866 527-7383) before 11:59 p.m. (EST) on February 6, 2017, inclusively. All registration forms must be submitted no later than 11:59 p.m. (EST) on February 6, 2017, inclusively; for forms sent by Internet, the date and time of reception will serve as proof of receipt within the deadline. The deadline for telephone registrations is 7:59 p.m. (EST) on February 6, 2017, inclusively. If, due to computer problems, registrations cannot be adequately integrated into the Challenge website by February 6, 2017, the organizers may decide to extent the registration period. If this is the case, a special note to this effect will appear on the home page of the Quit to Win! Challenge website.
  3. The registration form must be sent by one of the following means:
    • By Internet: by filling out and submitting the online registration form on the Quit to Win! Challenge website at quitchallenge.ca
    • By telephone: through the iQuitnow helpline (1 866 527-7383)
  4. Each participant will receive a registration confirmation (immediately if registering on the website and by mail if registering by telephone).
  5. For support, participants can register for the Quit to Win! Challenge either with a non-smoking sponsor or with a fellow smoker who also wants to quit. Participants, whether they register with a non-smoking sponsor or with a teammate, need to fill out only one registration form, entering the contact information of both parties. In the case of online registration, the participant and his or her sponsor or teammate will receive a registration confirmation email containing a confirmation number for each person. In the case of telephone registrations, participants and their sponsors or teammates will receive their registration confirmation at the address provided.
  6. Participants registered in the 2017 Quit to Win! Challenge can increase their chances of winning a prize by inviting a friend to take up the Challenge. Participants must include the referred friend's email address in the space provided on the form. If a referred friend registers for the Challenge, the participant will double his or her chances of winning. To invite a friend, access your profile.
  7. In submitting the registration form through the Quit to Win! Challenge website or by telephone, participants declare that they have read and understood the rules and regulations of the Quit to Win! Challenge, will comply with them, and be committed to respecting them.
  8. In submitting the registration form through the Quit to Win! Challenge website or by telephone, participants confirm their name, age, residential address, contact telephone numbers, email address, as well as the contact information for their chosen sponsor or teammate.
  9. In submitting the registration form through the Quit to Win! Challenge website or by telephone, participants agree to actively participate in the Quit to Win! Challenge by stopping smoking at the time of their choice between December 20, 2016, and February 6, 2017, inclusively, and not smoking from February 6 to March 19, 2017, inclusively.
  10. In submitting the registration form through the Quit to Win! Challenge website or by telephone, participants agree to not smoke up until the date that the winners are declared (March 22, 2017) and, if applicable, until they have passed a screening test.
  11. In submitting the registration form through the Quit to Win! Challenge website or by telephone, participants agree to not smoke during events related to the Quit to Win! Challenge, such as the prize ceremony, press conferences, etc.

 

IV. Sponsors and teammates
  1. The person chosen by the participant as a sponsor or teammate must reside in Quebec as of at least December 20, 2016. He or she must know the registrant well and spend time with him or her regularly (e.g., a friend, a work colleague, or a family member). The role of the sponsor or teammate is to support and encourage the registrant (or provide mutual encouragement) in their efforts to succeed at the Challenge and stop smoking.
  2. Sponsors may sponsor or support more than one smoker.

 

V. Description of the prizes
  1. Grand Prize 1 – Participants aged 18 and over, courtesy of Air Transat and Melia Hotel International Cuba.

An all-inclusive trip for two (2) people to the 4½ star Melia Peninsula Varadero hotel in Cuba.

This prize includes:

  • return economy airfare on an Air Transat flight departing from a Canadian city with service to Varadero, Cuba, in accordance with  Air Transat's flight program;
  • transfers by bus between the Varadero airport and the Melia Peninsula Varadero hotel for two (2) people;
  • one (1) week (seven (7) nights lodging) in double occupancy, all-inclusive formula for two (2) people in the Melia Peninsula Varadero hotel, a  4½ star complex;

This includes:

  • buffet breakfast, lunch and dinner daily, and two (2) à la carte dinners per week (reservations assigned in advance by the hotel), unlimited domestic drinks and a selection of international drinks, a daily sports and activities program, and access to the nightclub (drinks included).

All expenses not mentioned above are the sole responsibility of the winner and his or her travel companion.  The grand prize is valid for one trip only, to be taken between April 18, 2017, and February 25, 2018. However, dates are subject to flight availability at the time of reservation. Certain conditions apply (see the appendix to these rules and regulations).

Participants who pick up their Support kit in their PJC Jean Coutu pharmacy and who validate the barcode before March 19, 2017 have a chance of winning one of 5 gift cards, each valued at $100, redeemable at any Jean Coutu store.

  1. A $250 Jean Coutu gift card (Facebook prize #TrucGagnant)

Participants who share a picture on Facebook between February 21 and 27, 2017, with the hashtag #TrucGagnant and tag the Quit to Win! Challenge page in their post have the chance to win a gift card valued at $250, redeemable at any Jean Coutu store.

 

VI. Awarding of prizes and draw

Prizes will be awarded as follows:

  1. The two (2) Grand prizes will be drawn from all participants age 18 and over duly registered in Quebec. Only one prize will be drawn in each household. Any additional participation per household will be canceled.

    The random draws for the potential winners will take place at 10:00 a.m. on February 27, 2017, at 300 Léo-Pariseau Street, suite 1810, Montreal, Quebec. The potential winners will be contacted by telephone starting on March 1, 2017, by the members of the eligibility committee, and must answer a questionnaire designed to verify the eligibility criteria for the Quit to Win! Challenge listed in section II of the present rules and regulations. At the beginning of the call, potential winners will not be informed of their status as potential winners, nor of the nature of the verification of the eligibility criteria.

    These potential winners will then be contacted again by telephone starting on March 22, 2017, by the members of the eligibility committee in order to answer a questionnaire designed to verify the eligibility criteria for the Quit to Win! Challenge listed in section II of the rules and regulations.

  2. The five (5) Jean Coutu gift cards (worth $100 each) will be drawn on March 22, 2017, from among those registered participants who have validated the barcode on the bottom of their Jean Coutu Quit Kit on the website at quitchallenge.ca, or by telephone at 514 985-2466, ext. 350. Participants who validate their code by phone must indicate their first and last names, telephone number, and barcode.
  3. To be declared a winner and receive his or her prize, each potential winner must first demonstrate by his or her answers to the questionnaire that he or she has completed the Quit to Win! Challenge, in other words, has not smoked during the six weeks of the Challenge, that is, from February 6 to March 19, 2017, inclusively, by informing the members of the eligibility committee of the steps that he or she took. The potential winner will be taken at his or her word and presumed to be in good faith. Second, the potential winner will have to correctly answer, without assistance, within a given time, a skill-testing mathematical question asked over the telephone at a time previously agreed to by the parties. Finally, the potential winner will have to pass a screening test in the form of a urine test or any other form of test deemed relevant, if the eligibility committee of the Quit to Win! Challenge so requests. The sponsor or teammate registered as part of the pair may be contacted to testify whether, to his or her knowledge, the potential winner has not smoked during the period set out in the rules and regulations.
  4. If the potential winner cannot be reached after two (2) days of attempts, at the rate of two (2) calls per day (48 hours after the first call), if there is no response or no call-back after a message has been left in his or her voice mail, the potential winner will not have the right to a prize. If applicable, the next potential winner on the list will be called. For whatever reason, no delay may go beyond 48 hours from the time of the first call.
  5. After having reached the potential winners and having confirmed verbally with witnesses their eligibility for the Quit to Win! Challenge prizes, the members of the eligibility committee will provide the potential winners with an individual written declaration attesting to the fact that they respected the conditions set out in the present rules and regulations, as well as a waiver. This declaration does not apply to the sponsors or teammates, but their names will be mentioned with that of the winning participant. The potential winner must return one copy of the declaration by fax to the organizers of the draw and send them the original, duly signed, by mail within the prescribed deadline. If the deadline is not respected, the potential winner will be disqualified.
  6. Said declaration must be read and signed by the winner. The latter must return a signed copy by fax to the organizers of the draw and / or send by mail the original signed declaration, within five (5) working days after the confirmation call. If the deadline is not respected, the potential winner will be disqualified. A parent or guardian must sign the declaration of a potential winner who is a minor.
  7. If a potential winner does not fulfil the requirements of the present rules and regulations, he or she will be automatically disqualified, and the prize will be awarded to a new participant by random draw, according to the same eligibility criteria.
  8. Capsana is the initiator of the Quit to Win! Challenge and is solely responsible for the organization of the draws, which are conducted according to a most rigorous process and supervised by a committee composed of in-house representatives involved in the production of the Quit to Win! Challenge (“eligibility committee”).
  9. The prizes must be accepted as awarded and described in the present rules and regulations for the Quit to Win! Challenge. They are not transferable and may not be replaced by other prizes, nor are they exchangeable, in whole or in part, for cash or other goods. Capsana reserves the right to substitute a prize of an equivalent value for a prize that cannot be awarded as described in the present rules and regulations.
  10. The chances of winning depend on the number of registrations received during the registration period.

 

VII. Commitment of the winner
  1. A press release will be issued to reveal the names of the winners and the results of the Quit to Win! Challenge. The names of the winners will also be posted on the Challenge website at quitchallenge.ca.
  2. A winner must consent, if required, and without remuneration, to have his or her name, photograph, voice, city and region of residence, and/or all declarations related to winning the prize be used by the organizers of the Quit to Win! Challenge for communication or advertising purposes related to the Quit to Win! Challenge.

 

VIII. Authority and responsibilities
  1. Capsana holds final authority with regard to judgment and decisions regarding registration of participants, evaluation of eligibility of potential winners of the Quit to Win! Challenge, and the awarding of prizes.
  2. Subject to application of An Act Respecting Lotteries, Publicity Contests and Amusement Machines related to the present Quit to Win! Challenge, any dispute with regard to the organization or conduct of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux du Québec for resolution. A dispute with regard to the awarding of a prize may be submitted to the Régie des alcools, des courses et des jeux du Québec only for the purpose of an intervention to attempt to resolve such dispute.
  3. Capsana, its employees and consultants, and the organizers, partners, and sponsors of the Quit to Win! Challenge may not be held responsible in the case of an accident, loss, theft, or any other problem or costs related, directly or indirectly, to the acquisition or use of a prize.
  4. The applicable taxes under An Act Respecting Lotteries, Publicity Contests and Amusement Machines have been paid.
  5. The refusal to accept a prize frees Capsana from any obligation related to said prize, including its delivery.
  6. Capsana and its agents are not responsible for any technical, mechanical, computer, telephone, telecommunications, distribution, or production errors and may cancel or withdraw the draw if such errors arise, without obligation and without prior notice, at its sole discretion, subject to authorization by the Régie des alcools, des courses et des jeux du Québec.
  7. Capsana is not responsible for damages caused to the computer system of a user following his or her participation in the contest, nor in the downloading of information necessary to participate in the contest.

 

APPENDIX

Grand Prize 1 – Quit to Win! Challenge – Transat

The winner will be provided with these Rules as well as a waiver of responsibility form that he or she will have to sign (along with his or her travel companion), attesting that they have read, understood and agree to be bound by and comply with them.

  1. The winner and his or her travel companion must be Canadian citizens and have reached the age of majority in their province of residence as of March 22, 2017;
  2. The winner and his or her travel companion must make the return trip together. The prize must be used by February 25, 2018 at the latest (cut-off date for the return  trip);
  3. The request for reservations must be made by October 31, 2017 at the latest; The following dates are excluded: Easter holidays (from April 8 to April 17, 2017), Quebec construction holidays (from July 22 to August 6, 2017) and the Christmas and New Year holidays (from December 17, 2017 to January 6, 2018);
  4. Packages are offered depending on availability and the schedule in effect;
  5. If the winner and his or her travel companion should require transportation to one of our departure cities, the cost of such transportation is the winner's responsibility;
  6. Note that general conditions apply to this reservation (please consult the Transat brochure in effect);
  7. In case of unforeseen events, Transat reserves the right to change the travel dates by a few days after having advised the winner thereof; 
  8. No extension to the valid travel period is allowed, and the prize can not be exchanged, transferred, refunded or redeemed for cash;
  9. It is the responsibility of the winner and his or her travel companion to purchase adequate travel insurance before the departure. The insurance is at expense of the winner and his or her travel companion;
  10. Applicable taxes and other service charges are Capsana’s responsibility: airport fees, custom duties, border tax, travel cards, and surcharges);
  11. Transat reserves the right to propose a comparable product in the case of a program cancellation, force majeure or any other situation that is not within the control of Transat;
  12. Personal expenses are the responsibility of the winner and his or her travel companion;
  13. All required travel documentation (passport, visa, etc.) is the responsibility of the winner and his or her travel companion (and any other passengers of his choosing, if any); he or she must obtain them before departure.

  13. All required travel documentation (passport, visa, etc.) is the responsibility of the winner and his or her travel companion; he or she must obtain them before departure.
